Sad tale: TRPWL‘s favorite conspiracy theorist and pariah Monica Foster is still at it
As TRPWL receives word of a new litigant who plans to file suit against Monica Foster, we bring you this update report…
Beginning in February 2014, adult business washout and rabid anti-semite Monica Foster began posting Twitter comments and drafting defamatory blog posts falsely claiming that Jennifer Randazza, wife of noted Nevada attorney Marc J. Randazza, has been involved in prostitution, organized crime, and pornography.
On April 10, 2014, in hopes of putting an end to the defamation and harassment, Jennifer Randazza filed suit in District Court in Nevada, for claims of defamation and false light.
Foster, who, according to court documents, is nearly penniless, has had her court fees waived and has been acting as her own counsel in the case.
Foster’s defense was that she had received “an electronic communication” from someone claiming to be Jennifer Randazza — and who Foster believed to be Jennifer Randazza — and was merely repeating what was contained in the communication.
Foster has never produced the text of any such communications, and the case comes down to this: 1) whether Foster ever actually received any “electronic communications” containing the charges she made publicly, and 2) if she did receive such an “electronic communication”, whether Foster was right to have relied on a communication of such flimsy authenticity.
In May, Foster filed a rambling Motion To Dismiss (MTD), and, at a July 1st hearing — at which the paranoid Foster made her “appearance” by telephone — the court learned that the “electronic communications” Foster has claimed were the basis of her defamatory posts do not exist. Foster’s motion was denied. In other words, the Randazza v. Mayers action survived Foster’s attempt to get it tossed out of court.
Also in May, the Randazzas had to file an Application for Order For Protection Against Stalking, Aggravated Stalking, or Harassment against the “obsessive” anti-semite, and in June the 35-year old Foster, real name Alexandra Melody Mayers, failed to show up for the hearing in that matter.
In a six-minute hearing in Las Vegas Justice Court, the Temporary Order For Protection was issued against Foster, requiring her to stay away from the Randazza family, their residence, his place of business, and their children’s schools. The full order may be viewed in this report.
At the time of the hearing, an Early Case Conference (something which is required pursuant to the Nevada Rules of Civil Procedure) in the Randazza v. Mayers defamation suit had been scheduled at the offices of Randazza Legal Group. Therefore the judge who issued the Order instructed Jennifer Randazza’s attorney to reschedule the conference via the document above so that Foster’s attendance would NOT violate the Order — a location other than the offices of Randazza Legal Group. Foster was then duly informed by Jennifer Randazza’s counsel, Theresa Haar, that the conference had been moved to the Las Vegas offices of Holland and Hart LLP, at 9555 Hillwood Drive.
The Amended Notice of Early Case Conference and the correspondence sent to Foster specifically mention the Order for Protection.
The purpose of an Early Case Conference is to discuss possible settlement of the case, and propose a plan for discovery. Naturally, it didn’t benefit Foster to discuss discovery in the case, because she would have had to talk about those pesky “electronic communications” that she cannot produce, and which everyone concerned is convinced never existed in the first place –so she no showed at the conference as well.
Her excuse? That she, the victim of a large conspiracy, was being lured into a scenario in which she would be violating the Order For Protection… In a strategy TRPWL has termed Suicide By Court, Foster has refused to attend any proceedings in the action(s) against her.
Foster’s latest court pleadings, continue this theme.
First, here’s her bizarre Notice of Hearing, which relates to the Protection Order case yet was filed August 18 with the court handling the defamation action.
“No where [sic] has Defendant ever posted a photograph or depiction of Xxxxxxxx Randazza directly…” LOL Nice qualifier, Foster. We’re confident the court will love that one.
Foster’s discussion of the “piece of artistic parody” she created that depicts Jennifer Randazza’a daughter receiving a gang bang award is priceless: it’s not a depiction of Randazza’s daughter, Foster claims, because her full name “is not written anywhere” on it.
Okay, Foster, then this is not a depiction of you.
Seemingly not satisfied that she’d evaded responsibility for her own acts and omissions up to her own standard of zero responsibility and full victimhood, Foster followed up by filing another document, a Statement, on August 24:
Nice to see Crystal Cox make her return in Foster’s pleadings. Isn’t it amazing how Foster’s pleadings have nothing at all to do with the facts in the case? She’s willing to talk ad nauseum about everyone on the planet EXCEPT Jennifer Randazza, the woman she defamed and harassed. Marc J. Randazza is not a party in this action, Foster.
Now Foster’s upset that TRPWL has access to court filings that are a matter of public record. The same filings Foster herself posts at her hate sites. When TRPWL publishes them, however, it’s part of a conspiracy to harass her. And did Foster, the owner of anti-sex worker and anti-semitic hate sites, actually type the words “biased commentary”? Wow.
Filed September 11, Foster’s most recent court filing is another doozy: Defendant’s Opposition to Motions To Compel Arbitration and To Stay and/or Dismiss The Proceedings. [SPOILER ALERT: yes, she now sees arbitration and out-of-court resolution as part of a massive conspiracy against her, too.]
